(on the same course, same day)
(i) In these Terms and Conditions "P&L" means P&L Software Systems Limited and "the Customer" means the party to whom goods or services are supplied by P&L.
(ii) These Terms and Conditions shall govern each transaction made by the Customer with P&L and shall supersede any previously published terms and conditions of business and shall override any terms and conditions stipulated, incorporated or referred to by the Customer in its order or negotiations.
(i) P&L will raise an invoice upon receipt of a signed confirmation form from the Customer. This will be paid in advance, no later than five days prior to the course date.
(ii) A signed Booking or Order Confirmation Form constitutes a firm contract with P&L unless otherwise expressly agreed in writing by a Director of P&L. Your attention is drawn to the terms stated below in the event of a cancellation by either party.
(iii) The Customer should regard a booking as firm unless P&L advises to the contrary.
(i) Cancellations must be notified in writing.
(ii) Once your sessions are booked, resources are allocated to them and them alone. All cancellations are subject to a minimum £75.00 administration charge; otherwise they are subject to the scale shown in the table below.
(iii) Postponements are in effect cancellations and are subject to the same terms.
(iv) In the event of cancellation by the Customer, fees may be charged on the following sliding scale:
| Less than 15 working days notice, but more than 9 days: | 40% of the agreed fee |
| Less than 10 working days notice, but more than 4 days: | 60% of the agreed fee |
| Less than 5 working days notice: | 80% of the agreed fee |
| Less than 2 working days notice: | 100% of the agreed fee |
(v) In order for courses to run at the prices quoted they must achieve minimum numbers. Whilst P&L will make every effort to run these courses P&L reserve the right to reschedule any course if it is not viable.
(i) P&L shall not be liable for any failure to perform the contract due or principally due to any circumstances beyond its control including but not limited to inability to secure labour materials supplied or transport, scarcity of fuel power or components, breakdowns in machinery, fire, storm, flood, Act of God, war, civil disturbance, strikes, lock-outs and industrial action in whatever forms.
(ii) These Terms and Conditions and any questions, disputes or other matters relating to them or to contracts made subject to them shall be governed by and determined in accordance with the Law of England.
